This session offers attorneys a comprehensive, step-by-step guide to litigating undue influence claims in Arizona, from evaluating timeliness and gathering key records to identifying the indicia of undue influence and navigating burdens of proof. Whether prosecuting or defending, participants will gain practical tools for assembling the puzzle of undue influence, including how to craft discovery strategies, and assess a decedent’s susceptibility through medical, physical, and social factors. Designed for new probate litigators, this CLE provides a clear road map for putting together a compelling undue influence case with confidence.
About our presenter:

AMANDA L. BARNEY is a Partner at Becker & House, PLLC. Amanda’s practice area is trust and estate litigation, with a particular focus on undue influence and financial exploitation. She is experienced in dealing with multi-jurisdictional trust and estate litigation, as well as litigation that deals with complex business and real property issues. Amanda is active in organized law, serving on the Young Lawyers’ Division of the Maricopa County Bar Association. Amanda is a co-author of Arizona Probate and Trust Administration and Litigation with Forms (Matthew Bender ed., 2023). She guest lectures at Arizona State University Sandra Day O’Connor College of Law on undue influence and other litigation issues. She attended Berry College in Georgia where she received her B.A. magna cum laude in Political Science in 2015. She then attended Arizona State University’s Sandra Day O’Connor College of Law where she received her J.D. in 2018. Amanda joined the firm shortly thereafter. In her free time, Amanda enjoys practicing yoga and hiking.
